| LICENSE AGREEMENT
By purchasing and downloading
a template from HelenDesign.com you agree to the following License
Agreement:
- The templates may be used for your own and/or
your customers' websites, but you may not put them on a diskette,
CD, website or any other medium and offer them for redistribution
or resale. This means that if you are a web developer and/or
consultant, you are free to use the templates in the design of
your customers' websites. However, the templates may not be resold
in any sort of collection, such as passing our templates over
to third parties in CD's and diskettes, or letting others download
our templates from your websites. In the event of such a practice,
HelenDesign.com will immediately terminate your membership privileges
and NO refunds will be made. Furthermore, by conducting such a practice,
you automatically waive any legal claims against HelenDesign.com.
If you do not abide by the terms of this agreement as described
above, HelenDesign.com will pursue legal action to the highest
extent.
- You are only granted a one-time-use license
for each template. (Note: if you are planning to use our templates
to design a website for your commercial client(s), it is advisable
to inform your client(s) in advance that you will be using pre-made
templates for their projects in order to avoid possible legal
disputes with your client(s).
- The templates are provided "as is"
without warranty of any kind, either expressed or implied. You
are responsible for adding or editing your website's content (e.g.
pictures, photos, and text) to the template itself. Technical
support will be limited to problems such as the alignment of graphics
and similar difficulties you experience. We suggest that you contact
your local web developer(s) for service and assistance.
- All images, graphics, and photos, are purchased and licensed from
third-party stock photo agencies. You may not
use the images, photos, and graphics anywhere else other than
the templates you have purchased. Please visit www.photodisc.com
or www.comstock.com
for any images you like to purchase.
- You understand that HelenDesign.com is not
responsible for the content, quality or merchantability of any
information, product or service offered herein and the user must
assume full responsibility to evaluate independently the accuracy,
completeness, quality and usefulness of any information or other
content. HelenDesign.com hereby expressly disclaims any and all
warranties, expressed and implied, including but not limited to
any warranties of accuracy, reliability, merchantability or fitness
for a particular purpose by any vendor, customer, associate
offering information, products, or any services linked to the HelenDesign.com
website. The user agrees that HelenDesign.com is not responsible,
and shall have no liability to such user, with respect to any
information, product or service offered by others who are linked
to the HelenDesign.com website. HelenDesign.com shall not be liable
for any damages allegedly sustained arising from use of the information,
products, and services.
- In no event shall HelenDesign.com be liable
for any damages including, but not limited to, direct, indirect,
special, incidental or consequential damages, or other losses
arising out of the use of or inability to use the templates from
HelenDesign.com.
- Helen Design is committed to protecting
your privacy. Helen Design will never sell personally identifiable
information about you or your business to any third party without
first receiving your permission.
- In order to protect you, Helen Design currently uses PayPal
as our payment collection source. PayPal uses Secure
Sockets Layer (SSL) software to protect your data and secure you
and your customers' transactions. SSL encrypts all your personal
information, including name, billing address, credit card number,
etc, as it is transmitted over the Internet.
- Dowload access to files will be removed 7 days after purchase.
Please make backup copies as deemed necessary. You will be required to make a new purchase
if you fail to download the template you have purchased within the
7-day period or for any file lost on your own behalf.
- There will be no refunds or exchanges after
you have made a purchase. All sales are final.
- HelenDesign.com's templates are created using
Dreamweaver. For optimal results, please edit with the same software.
- Helen Design may at any time, modify this agreement without
prior notice. An agreement will always be posted on our site for members
to review.
- If agreement terminates due to any illegal activity, all rights
granted to you under this agreement shall terminate immediately.
If Helen Design terminates this agreement or suspends your access
to Helen Design's Services and/or Products. Helen Design reserves
the right to delete any data files associated with your use of
the Helen Design Service or Products upon termination of this
Agreement.
- CREDIT CARD FRAUD IS A FEDERAL CRIME AND A FELONY
PUNISHABLE BY HEAVY FINES AND JAIL TIME. FRAUDULENT BEHAVIOR WILL
BE PROSECUTED TO THE FULLEST EXTENT OF THE
LAW. HELENDESIGN.COM WILL REPORT ANY FRAUDLENT TRANSACTIONS TO
INTERNATIONAL INTERNET FRAUD AGENCIES AND WILL PROSECUTE WHENEVER
AND WHEREVER POSSIBLE TO THE FULLEST EXTENT OF THE LAW.
